Terms of Service

1. Who you are contracting with

Sean Jeremiah Vella St John, trading as Borgohost. A Malta sole proprietorship, not a limited company. The registered address and VAT number are on our legal notice, and both appear on every invoice we issue you. Contact support@borgohost.com.

2. What the service is

Managed hosting for one WordPress website per subscription, on shared infrastructure we operate. It includes daily off-site backups kept 14 days, WordPress core and plugin updates on a weekly window, uptime monitoring, and email support inside the published window. It does not include domain registration, DNS hosting, email mailboxes, outbound mail, a staging site, or any included hours of development work.

3. Term, renewal and cancellation

You choose a prepaid term of 1, 3, 6 or 12 months. The term renews automatically at the same price for the same length until you cancel. You can cancel online at any time; cancellation takes effect at the end of the paid term and the site keeps running until then.

  • 1 month: EUR 6.00 excluding VAT, which is EUR 6.00 per month.
  • 3 months: EUR 16.00 excluding VAT, which is EUR 5.33 per month.
  • 6 months: EUR 32.00 excluding VAT, which is EUR 5.33 per month.
  • 12 months: EUR 60.00 excluding VAT, which is EUR 5.00 per month.

4. Price changes

We may change prices. If we do, the new price applies from your next renewal, we tell you at least 30 days before it takes effect, and you can cancel before then at no cost. We will never silently increase a recurring charge.

5. If you do not pay

If a renewal payment fails we email you and retry. Your site is suspended 7 days later on a 1-month term, or 14 days later on a longer term. Suspension means the site serves a holding page: your files, database and DNS are untouched and backups continue. Pay and it comes back, usually within five minutes and without you needing to ask. The service is terminated 45 days after the first failure, and data is destroyed 75 days after it. We tell you before each step.

6. Backups, stated honestly

We take daily off-site backups and we test restores. You should still keep your own copy. We are not liable for data loss beyond restoring the most recent backup we hold, and if that backup is itself broken we will say so rather than pretend.

7. No uptime guarantee

We publish no uptime percentage and offer no service credits. This is a one-person business with a stated support window, and a number we could not honour would be worse than no number. If the service is unavailable and you want to leave, tell us and we will refund the unused part of your term.

8. Your obligations

You must comply with the Acceptable Use Policy, keep your account credentials safe, and be entitled to publish what you publish. You are responsible for the content of your site.

9. Suspension and termination by us

We may suspend immediately for a breach of the Acceptable Use Policy, for a payment dispute, or where we are legally required to. Where we act we tell you what we did and why. We may terminate with 30 days notice for any other reason, and in that case we refund the unused part of your term and help you move.

10. Liability

Our total liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, lost profits, or lost revenue. Nothing here limits liability that cannot be limited by law, including your statutory rights as a consumer.

11. Governing law

Maltese law, and the courts of Malta. If you are a consumer, this does not deprive you of the protection of the law of your own country of residence.

12. Changes to these terms

We may change these terms. Material changes are notified at least 30 days before they take effect, with a right to cancel before then.
